The State to be sued for confiscation of helicopter in Mexico

The illegal transfer of the Eurocopter helicopter from Mexico to Panama, registered N1626L, was a strong argument for lawyer Sídney Sittón to present a complaint yesterday at the Embassy of the United States (U.S.) against the Panamanian State on behalf of the US corporation Aircraft Trust & Financing.
After the legal action has been filed, the U.S. Embassy should refer the complaint to Office of Federal Aviation Administration of the United States (FAA) for an investigation to be opened.
The jurist reiterated that pilots Ricardo Garay and Jaime Herrera, without a valid license issued by the U.S. Department of Transportation, flew the helicopter, in violation of federal laws and regulations of civil aviation of the United States, endangering the lives of citizens.
He added that since the pilots were not properly license to fly the aircraft, they did not count on a flight maintenance log either.
Although the Supreme Court of Justice (CSJ) admitted the constitutional guarantees recourse, which nullified the action performed by anti-corruption Prosecutor, Tania Sterling, the Public Ministry (MP) has already announced that the return of the asset concerned will not take place as yet.
However, the MP said that Eurocopter EC-13T2 was released and placed under Ministry of Economy and Finance´s guardianship until the case is decided upon.
Dimas Guevara, member of the legal team of the Martinelli Family, indicated that Prosecutor Sterling, based on the Court´s arrangement, should revoke the confiscation and return the asset until the case is handled.
It was considered that this officer should not wait until an action of contempt is taken that could tarnish the whole justice system
Failure to comply with the provisions of the Court may constitute an abuse of authority. "The public prosecutor's office is using concepts completely opposing the Code during the investigation phase ", he said.
"However, whenever other elements arise that should be investigated, they do not do that. Many of these cases will fail due to the lack of legal formality that has taken place", he added.
