A new complaint against a senior official of the government of Juan Carlos Varela has been filed in the office of the Attorney General of the Nation, Kenia Porcell.

It is the deputy health minister, Miguel Mayo, who is accused of the crime of falsifying, the allegedly lied in his sworn statement of assets once assumed the position of Deputy Minister of Health.

Therefore, in denouncing the dismissal of this official as a precautionary measure for securing evidence that may support this investigation it is requested.

The  Panama America had access to the complaint and the documents supporting the charge against Deputy Minister Miguel Mayo.

In the complaint, Macario Quinones, who stands, says Mayo, with this action, may have evaded taxes.

"When a person declares less income that actually generates or falsifies his affidavit, what it does is take silver to the State" said Macario Quiñones in the complaint lodged with the office of the prosecutor.

Quinones called immorality this alleged behavior of deputy minister on the grounds that public funds should have reached state coffers, referring to the alleged tax evasion by declaring less income is "embolsillando shamelessly" that really have .

The complainant provided a copy of the affidavit of the official stating that in 2014 earned an income of 18 thousand 229 dollars, which in his opinion "creates inconsistency" to do the math with the monthly $ 6,000 that accrued in the second half of 2014, when he began his tenure in office.

Argument with supporting evidence from the payroll of the Ministry of Health, where monthly earns a salary of more than $ 3,000 in spending represented $ 3,000, making a total of $ 6,000 monthly.

The complaint should be investigated by the Attorney General's Office.

"During this year (2014) generated $ 36,000, just in salary and expenses, which means a steady income to report," said the complainant.

However, a source close to the deputy minister said in May that this claim is false and obeys an evil orchestrated by someone who intends to do harm.

The source said that so far has not reached a notification that there is a complaint against the deputy Mayo.

He argued that there is no tax evasion, since they are charged for direct discount to pay.

In addition, the source reported that the deputy minister in his statement of assets 2014 57,400 dollars he received for professional services as a specialist doctor he said.

Sanctions

The Criminal Code, Article 366, establishes penalties of up to eight years in prison against those found guilty for the crime of falsifying a document.

The standard indicates that he is guilty of this offense who "falsify or alter, in whole or in part, a public document, a public document or authentic so may result in injury."

Supports the complainant that an affidavit enters this as a public document, therefore there is sufficient evidence that the deputy minister is processed Mayo.

Similarly, in the aspect of the consequences of damage, says the jurist who would be harmed because the State by declaring less income, less taxes paid, causing a reduction in public finances.

The rule which uses the complainant adds that "same penalty shall be imposed on whoever insert or make insert into a public or authentic document concerning false statements to a fact that the document be tested, provided it can cause injury to another."

Las Palmeras

In the complaint, the attorney Quiñones refers to a second behavior of tax evasion, which consists of valuing a farm owned by the deputy minister in May called Las Palmeras, located in Costa del Este.

"That residence with a registered $ 76,000 334.20 value, but according to appraisal by the MEF, the same should be paying tax in response to an actual value of $ 438,000 425.08," says the lawyer Macario Quiñones in its complaint.

The complaint also refers to the additional revenue that the Deputy Minister has allegedly received as professional services in a private hospital in the country, and a clinic, which, according to the complainant, is owned by the deputy minister and members of his family.

According to Quinones, the official pays only $ 700 annual tax when their incomes are much higher, with which can assume two mortgage loans real estate and a luxury vehicle.

"It is our opinion that not only an issue of ethics can not be an authority that simply lie in affidavits, lie on financial disclosure and hide assets and wealth," Quinones said.

In the Ministry of Health they indicated that for the moment they would not comment until they knew issue in detail the contents of the complaint.

However, according to Quinones, the complaint, which makes as a citizen, is motivated by the need "to know in whose hands are the machinations of state funds and what moral is the person who manages these funds."
