• Para ser elegido como defensor del pueblo la persona debe ser de nacionalidad panameña, debe estar en pleno goce de sus derechos civiles y políticos, ser mayor de 35 años, no haber sido condenado por delito doloso con pena privativa de la libertad de cinco años o más, debe tener solvencia moral y prestigio reconocido, no tener parentesco dentro del cuarto grado de consanguinidad y segundo de afinidad con el presidente de la República ni con ningún otro miembro del Consejo de Gabinete ni con magistrados de la CSJ ni con diputados.

• El defensor tomará posesión del cargo inmediatamente después de la publicación de su nombramiento, ocupará el cargo por cinco años y podrá ser reelegido una sola vez.
