Paniza based its decision on that since 22 September last year the office of instruction must refer the case to the court to continue with the judicial business, however, Moore prosecutor sent him to the end of January this year when the term was summarily defeated.

The judge's decision Paniza was predicted by the former adviser of the National Security Council, Luis Fuentes Montenegro, who explained that the actions of Moore, from September 22, 2015, in summary for the purchase of radars, could be nil.
Montenegro sources said that when the denial of an extension is appealed, the record should remain in the prosecution and not carried out judicial proceedings, but the prosecutor continued with investigations although there was no response to his request for more time.
