A case drown in controversy

Five habeas corpus have been issued against the detention measures ordered by prosecutor Moore.

If one had to define the judicial process over the irrigation project Riego de Tonosi, one would only need two words: “drawn-out and controversial”.

Drawn-out because no preliminary hearing has taken place one year after the investigation was launched. This is because the array of legal actions the defense has resorted to yet to be defined by the court in question.

The latest being a claim by the defense team of businessman Felipe Virzi, which alleges that the defendant enjoys immunity from prosecution in virtue of being a contender in the election of the national executive committee of the Partido Revolucionario Democratico (PRD).

It is now contingent on the Electoral Tribunal to issue an order to remove the electoral immunity claim by Mr. Virzi. Meanwhile, the process is on hold.

And controversial because case prosecutor Zukeika Moore has issued multiple preventive detentions orders against the accused, which have been widely seen as excessive. As a result, five habeas corpuses were presented by the respective legal defense teams.

This is the second time that hearings has been suspended, the first being on June 6. The next hearing is now expected on November 14 this year.
